Article 1 (General Terms)
- This Terms of Use shall apply to the Common Account Service using the JaM id issued by East Japan Railway Company (hereinafter referred to as the "Company" and/or "we"), and to the Client Services through the Common Account Service. The User shall use the Common Account Service and each Client Service (hereinafter collectively referred to as the "Service") upon agreeing to this Terms of Use.
- This Term of Use applies to all Users who use the Service.
- When using the Service, the User shall comply with this Terms of Use, etc., and any other conditions for each Client Service which are individually stipulated by the Company and the Designated Service Provider, in addition to this Terms of Use.
Article 2 (Definition)
The meanings of the terms used in this Term of Use shall be as follows.
- "User" means an individual who uses the Service by agreeing to this Terms of Use and registering through the prescribed authentication process.
- "Common Account Service" means the service of issuing JaM id, managing registration information and user authentication, etc. in the Service.
- "Common Account Service Website" means a website that shows how to use the Common Account etc. (https://jam-id.jp/)
- "Client Services" means the services provided by the Company or the Designated Service Provider through the Common Account Service, and the scope is indicated on the Common Account Service Website.
- "Designated Service Provider" means a business entity that sells products or provides services by itself or acts as an intermediary for the sale of products or provision of services by third parties through the Common Account Service, as approved by the Company through prescribed procedures.
- "Settlement Service" means a payment settlement service used by a User to pay for the Client Service to the Company or a Designated Service Provider.
- "Subject Transaction" means a transaction that occurs as a result of use of the Service between a User and the Company or a Designated Service Provider or a third party intermediated by a Designated Service Provider.
- "Registered Payment Method" means a payment method such as credit card, and internet payment information of Mobile Suica, etc., registered by a User in order to use the Settlement Service.
- "Mobile Device" means a smartphone, tablet, or other device owned by a User to use the Service.
- "Anti-Social Forces" means an organized groups (boryoku dan),members of organized crime group (bouryoku danin), persons who have not been members of an organized crime group for 5 years, quasi-member of an organized crime group (bouryoku dan jun kouseiin), a related or associated company of an organized crime group (bouryoku dan kankei kigyou), special intelligence violent groups, and others similar thereto.
Article 3 (For Ringo Pass Users)
Users who have opened an account with the "Ringo Pass Service" provided by the Company may use such account for the Client Service under the conditions set forth in this Term of Use.
Article 4 (Issuance and Integration of Common Accounts)
- The Company will issue a common account that allows the User to log in to the Client Services in accordance with the conditions stipulated in this Term of Use.
- The User will transmit the authentication information of the common account using the Client Services and use the Client Services through authentication of the common account, in accordance with the methods designated by the Company.
- The User shall use the Client Services on their own responsibility, and the Company shall not be responsible for any content of the Client Service provided by the Designated Service Provider or its provision, etc.
Article 5 (Use of the Service)
- The User shall, when using the Service, register the information (e-mail address, password, etc.) necessary to open an account on the Common Account Service in advance, and open an account after obtaining the prescribed authorization.
- The User shall register information related to payment methods (credit card information (name, expiration date, card number, and security code), internet payment account information for Mobile Suica, etc.) and authentication media information (transportation system IC card ID information, etc.) with the Common Account Service in the case of necessary for use of the Service.
- The method to use the Client Service shall be in accordance with the method separately provided to the User for each Client Service.
- When the User uses the Settlement Service, the payment for the Subject Transaction shall be made by the Registered Payment Method. In such case, the User shall make payment in accordance with the terms of use, etc., stipulated by the provider of the Registered Payment Method.
- If the User uses a credit card as the Registered Payment Method, payment under the Settlement Service shall be made in a single payment only.
- Communication charges incurred in the use of the Service shall be borne by the User.
- Any person who falls under the category of Anti-Social Forces is not allowed to use the Service at all.
- If we deem it necessary to investigate the facts of the User's use of the Service, such as when fraudulent acts by the User are suspected, we may request the User to cooperate with our investigation by conducting interviews, providing information related to the Registered Payment Method and identification documents, or other necessary cooperation. The User shall cooperate with this request. As a result of such investigation, we may refuse the registration for the Common Account Service.
- If the entire Service is terminated in accordance with Article 8, the User may not use the Service again.
Article 6 (Use of Common Account Service, etc.))
- The User shall register truthful and accurate information in his/her account opened in the Common Account Service. In addition, the User shall always keep the information registered in his/her account accurate and up-to-date, and if there is any change in such information, the User shall promptly change the registered information in accordance with the prescribed procedures.
- The User shall not engage in any activity that may compromise the security of his/her account or any other unauthorized activities.
- All rights and obligations related to the account belong exclusively to the User of the account, and the User may not transfer, lend, or inherit these rights and obligations to a third party.
- The User may request deletion of his/her account by completing the prescribed unsubscribe procedures. If deletion of account is requested, provision of the Service will cease and account information will be deleted after a certain period of time. However, if there are transactions for Client Services for which payment has not been completed, the account information will be maintained until such payment is completed separately.
- If a User's account is deleted in accordance with this Terms of Use, the User will not be able to use the Service.
Article 7 (Cancellation, Rescission, etc. of Subject Transactions)
- If a User wishes to cancel or revoke a Subject Transaction and request a refund after having executed payment for the Subject Transaction using the Settlement Service, in accordance with the terms of use of the Client Service applicable to the Subject Transaction, the User may request a refund in accordance with the procedures, etc. prescribed by the Designated Service Provider to the extent required by laws and regulations.
- If a refund is approved in accordance with the procedures, etc. in Paragraph 1, the refund shall be processed in accordance with the terms of service, etc. stipulated by the provider of the Registered Payment Method.
- Even if a refund is approved through the procedures etc. in Paragraph 1, the User may not demand a refund in cash from us or the Designated Service Provider.
- In the event of any problems related to cancellation or revocation or any other problems regarding the Subject Transaction, the User shall resolve such problems through the support of the Client Service.
Article 8 (Management of Mobile Device)
- The User shall properly manage his/her Mobile Device at his/her own responsibility by setting a password on the Mobile Device to prevent a third party from using the Service.
- In the event of loss or theft of the Mobile Device, the User shall immediately notify the Company and follow the procedures for deletion of the account.
- In the case of the preceding paragraph, the User shall, at his/her own responsibility, take necessary measures such as locking the Mobile Device with the Mobile Device's telecommunication company, etc., and taking necessary measures such as suspending the use of the Registered Payment Method with the provider of the Registered Payment Method.
- Except in the case of willful misconduct or gross negligence on our part, we shall not be liable for any damage caused by unauthorized use of the User's account by a third party due to loss or theft of the Mobile Device or for any other reason.
Article 9 (Suspension of Use of the Service, etc.)
In the event that a User falls under any of the following items, the Company may suspend or discontinue the User's use of all or part of the Service in whole or in part.
- When a User registers false or inaccurate information when registering for an account or otherwise providing User’s information to the Company, or when a User fails to change registered information even though such change is required.
- When a User violates this Terms of Use or any other conditions stipulated by the Company in connection with the Service.
- When a User uses the Service in a manner other than the prescribed usage.
- When a User violates the terms of service of the Client Service or the terms of service stipulated by the provider of the Registered Payment Method in relation to the Service or the Subject Transaction.
- When the use of the Registered Payment Method is suspended.
- When the Registered Payment Method has been issued fraudulently, or when the Registered Payment Method has been used for fraudulent or unfair purposes.
- When the User fails to make payment to the provider of the Registered Payment Method in respect of a Subject Transaction.
- When the Service is used for the purpose of cash conversion or for any other unauthorized or improper purpose.
- When a foreclosure, bankruptcy, petition for civil rehabilitation, or other event that is recognized as a significant deterioration of the User's credit states has occurred.
- When we deem the use of the Service by the User to be inappropriate in cases similar to those described in the preceding items.
Article 10 (Suspension, Termination, and Modification of the Service)
- In the event of any of the following events, the Company may suspend all or part of the Service without notice to the User.
- In the event of malfunction or failure of the system, server, or communication lines related to the Service, or other equipment, etc.
- In the event of maintenance, inspection, repair, or modification of systems, servers, communication lines, or other equipment, etc. related to the Service.
- When provision of the Service becomes impossible due to fire, power failure, etc.
- When provision of the Service becomes impossible due to the convenience or judgment of the registered settlement method provider, etc. or its affiliated companies.
- When the Designated Service Provider discontinues the Subject Transactions.
- When the Service cannot be provided due to force majeure such as earthquakes, floods or other natural disasters, wars, riots, labor disputes, changes in laws and regulations, etc.
- When we deem it necessary to temporarily suspend the Service for operational or technical reasons.
- When we deem it necessary to temporarily suspend the Service in other cases similar to those described in the preceding items.
- The Company may terminate or change all or part of the Service at any time by giving prior notice to the User. However, if the impact of the change on the User is minimal or if such change is for the convenience of the User, the Company may change the Service without prior notice to the User.
Article 11 (Disclaimer)
- Even if the User or a third party suffers damages due to the suspension, discontinuation, interruption, or change of all or part of the Service in accordance with the preceding two articles, the Company shall not be liable for any such damages.
- Even in the event that we are liable to the User for damages under this Terms of Use or laws and regulations, our liability for such damages shall be limited to the amount of the obligation for the Subject Transaction that caused such damages. However, this shall not apply to damages incurred by the User due to intentional or gross negligence on the part of the Company.
- With respect to the contents of the Service and information etc. obtained by the User through the Service, the Company makes no warranty as to the authenticity, accuracy, recency, usefulness, reliability, legality, or non-infringement of third party rights of the contents.
- The Company does not warrant that the Service is free from any factual or legal defects (including defects, errors, bugs, or infringements of rights related to safety, reliability, accuracy, validity, security, etc.), or that the Company's systems, etc. are free from unauthorized access by third parties.
Article 12 (Intellectual Property Rights)
- All rights to all resources comprising the Service shall belong to the Company or third parties holding such rights, and the User may only use the Service.
- The User shall not perform any act that infringes on any rights including ownership rights, copyrights, trademarks and any other intellectual rights, portrait rights, rights of publicity, or rights related to the content material of the Service without the Company's permission.
Article 13 (Modification of this Term of Use)
The Company may change this Terms of Use without the User's consent by providing notice of such change on the Common Account Service Web Site, and such change shall become effective when the User can view the notice of such change by accessing the Common Account Service Web Site, unless otherwise provided for in this Terms of Use. After the modification, only the modified contents shall be effective.
Article 14 (Protection of Personal Information)
- We will strictly manage the User's personal information provided by the User to us in accordance with the Act on the Protection of Personal Information,other related laws and regulations, and Privacy Policy.
- The User shall agree to the Privacy Policy separately stipulated by the Company when using the Service.
Article 15 (Compensation for Damages)
In the event that a User causes or threatens to cause damage to the Company due to an act in violation of this Terms of Use, or an illegal or wrongful act, the Company may demand that the User shall cease said act and compensate the Company for damages suffered by the Company.
Article 16 (Governing Law, Jurisdiction)
- This Terms of Use and the Services shall be governed by and construed in accordance with the laws of Japan.
- The Tokyo District Court shall be the exclusive court of first instance for any disputes between the Company and the User in connection with this Term of Use and the Service.
Article 17 (Precedence of Japanese Version of Terms of Use)
This Terms of Use was originally prepared in the Japanese language. In the event of any discrepancy between the English-language version and the Japanese-language version regarding the interpretation of this Terms of Use, the Japanese-language version shall prevail.
